Court orders seizure of agency’s vehicles over unpaid debts

A state High Court sitting in Minna, Niger State capital has ordered the seizure of vehicles belonging to Niger State Environmental Protection Agency (NISEPA) over its failure to pay up debts owned to a consultant.

According to the court order, the agency was directed to pay N44.4 million to Remi Nigeria Limited for services rendered but the agency defaulted in the payment.

“And whereas default has been made in payment according to the said judgment/order and upon the application of the plaintiff, it was ordered that the execution should issue for the sum of N44,425,600 being part of the sum of N80,549,500.

“This is therefore to require and order you forthwith to make and levy the amount due to the plaintiff under the said judgment together with the costs of this writ and the costs of executing same, by distress and sale of goods and chattels of the defendants wheresoever they may be found within the Niger state Judicial divisional/magisterial district (except the wearing apparel and bedding of him and his family and the tools and implements of his trade to the value of N1,000).

“And also by seizing and taking any money, bank notes, cheques, bills of exchange, promissory notes, bonds of securities for belonging to the defendant which may be found or such part as may be sufficient to satisfy this execution and to bring what you shall have so levied into court and to make return of what you have done under this writ immediately upon the execution thereof”, the order reads in part.

The order further stated that the goods will be sold after the end of five days following the day which the vehicles were seized.
