Court of Appeal grants Muslim students’ wish to wear hijab in schools

The Court of Appeal sitting in Lagos has affirmed the rights of female Muslim students to wear head scarf to public schools in Lagos.In a unanimous decision, a five member panel the court set aside, the judgement Justice Grace Onyeabo of the Lagos High Court delivered on October 17, 2014 that held that the restriction placed on the use of the Hijab in primary and secondary public schools in Lagos State is not discriminatory.

Justice Onyeabo added that the ban placed by the state government did not breach sections 38 and 42 of the 1999 Constitution as claimed by members of the Muslim Students Society of Nigeria (MSSN).

The Registered Trustees of the MSSN had dragged the Lagos state government to court over the restriction of the use of the Hijab on or outside the premises of any educational institution in the state, on the ground that it violates their fundamental human rights, is wrongful and unconstitutional .
