Lagos PDP flays Ambode of fraudulent practices over delayed council poll

By Olaolu Oladipo, Lagos
The Lagos State chapter of the Peoples Democratic party (PDP), has
lashed out at the Akinwunmi Ambode led All Progressives Congress (APC)
government for what it termed the deliberate act of delaying council
polls in since October 2014.According to the party in a statement obtained on Sunday issued by the
Publicity Secretary, Mr. Taofik Gani, the situation is a manifestation
of mismanagement and stealing the council funds.
The party opines that the state Executive and the House of Assembly
are culpable in this deliberate delay.
It holds that the continual running of the councils by nomenclature of
executive secretaries and now sole Administrators is alien and
unintended by the constitution, adding that situation runs contrary to
sections 1(2) 1(3) and 7(1) of the 1999 Constitution.
According to section 1(2), “The Federal Republic of Nigeria shall not
be governed, nor shall any person or group of persons take control of
the government of Nigeria or ANY PART thereof, except in accordance
with the provisions of this constitution.
“By s1(3), any purported law by the lagos state house of Assembly
allowing executive secretaries or sole Administrators or whatever
management of the council’s other than as specified under S7(1) is
void.
“This is because any law inconsistent with the provision of the
constitution shall to the extent of the inconsistency be void’. S.7(1)
guarantees system of local government by democratically ELECTED local
government council.
According to the PDP, it has also given LASIEC 21 days ultimatum,
ending on 31st of July, to publish notice and guidelines for the polls
failure which it shall educate lagosians to consider their dealings
with the councils “as indeed continual dealings with the illegal
councils would amount to participating in the lawlessness, brigandage
and treason in our constitutional democracy”
“It is well known fact that the APC is not fashionable for any
political victory at this present time. This is the main reason why
they have delayed council polls for close to 3 years. This is no more
acceptable.
“The APC can at least allow the polls and go ahead to
characteristically rig the results. Blatantly denying the people of
representative government of their choice at that tier of government
is the height of impunity and constitutionalism in this government”
